butterfly Case III: To Be Continued

Wednesday, June 18, 2008

Randy arrived today via Philippine Airlines PR 103, from Los Angeles via Guam then Manila. His flight arrived an hour earlier so I had time to drop him home before going to Regional Trial Court.

Tintin and I arrived at RTC at 8:30 am but, we entered the court room at 11 am. The pairing judge was hearing the case of a minor rape victim so we had to wait outside until the inquest's done.

Our case is number 9th in the court calendar. The authorized representative of the Mun. of Cardona, Rizal, testified but, she will again testify on Sept. 24th. The pairing judge had to hear the rest of the cases and it was already past 11:30 am.

As usual, I paid my lawyer and my witnesses their appearance fees. I didn't know how we got home. My mind was flying, I was worried how I will explain to Randy that there will be another hearing set on September 24th at 11 am.

At home, even though Randy was disappointed, there is nothing we can do but, wait for the next hearing.

butterfly Case III: Another Reset

Tuesday, March 04, 2008

The supposed last (Case III) hearing scheduled on Friday, March 7th, was reset again on April 4th at 11:30 am. Reason: All Judges will have a convention on that day.

I called my lawyer, Atty. R and informed her about the reset of the hearing. Fortunately, she is available on April 4. I've waited for several more minutes until they're done with the correction on subpoena the sheriff (Darwin) will serve to the Civil Registrar in Cardona, Rizal.

As agreed upon, Pacette and I went to Cardona, Rizal to talk to the Municipal's Civil Registrar. To my dismay, I found out that Mr. Esteban died in October 2006, 8 months after he issued Non-Marriage License Certification under my name. No wonder the guy was not able to attend the hearing on November 12, 2007.

Edsel Natividad was the new Civil Registrar now. Upon reading the subpoena, they checked again the old records to verify Marriage License but didn't find any such figures on file. He promised to send a representative on April 4th hearing, since he has also another hearing scheduled on that day.

We're fortunate that Ramil, our cab driver, serviced us the whole day and didn't charged us too much.

Pacette and I did some grocery shopping on our way home.

We arrived home at past 2 pm. Randy was still online on Skype but, was so tired sitting my 3 world account in Tribal Wars. I told him to go to bed and I will sit his accounts as well.

After he logged out, I spent the rest of the day and night overeating... I think I am depressed.

butterfly Case II: NSO Annotation

Thursday, October 25, 2007

Pacette picked up the three (3) annotated copies of my live birth from NSO - East Avenue, with the following remarks:

"Pursuant to the Decision dated March 13, 2007 rendered by Judge T of the Regional Trial Court, National Capital Region, Branch XXX, Quezon City, under SPE. PRO. NO Q-06-XXXXX, the date of birth of the child is hereby ordered corrected from May 26, 1960 to June 6, 1960."

Certified Correct by Lenna L. Bosito (Archivist)

We're done with two cases and I am looking forward to Case III's last hearing on November 12th... many thanks to Randy for making these things possible.

Speaking of Randy, it's the fourth day he does not go to work. All classes are suspended due to wildfires in San Diego. It's unfortunate that another Sta. Ana winds is forecast on Sunday, which might make the wildfires worse.

I have stomach problems and suffering from diarrhea... I slept the whole day but the Skype was on and Randy talked to me from time to time updating me about what's going on. I couldn't talk much because I feel vomiting. I was able to eat something only at past 9 pm.

butterfly Case I: NSO Annotatation

Thursday, October 18, 2007

I have two good news today, first one is... Pacette claimed in my behalf three (3) NSO SECPA copies of void Marriage Contract (Case I), from NSO Releasing2 Section, East Avenue this afternoon, with the following remarks:

"Pursuant to the Decision dated January 25, 2007 rendered by Judge T. of Regional Trial Court, National Capital Judical Region, Branch XX, Quezon City, under Civil Case No. Q-06-XXXXX, the marriage between me and Abdulelah is hereby declared void from the beginning."

Certified Correct by Adoracion M. Valenzuela (Archivist)

Pacette failed to pickup the three (3) NSO SECPA copies of corrected live birth certificate (Case II) because NSO didn't add the remarks made in 2003. This is the second time they made a mistake. First one was last year which Pacette corrected with Legal Instrument. Pacette had to go to Vibal Bldg and secure the copy they corrected last year. My sister got the corrected copy and submitted it to NSO East Avenue for correction. She has to come back on the 25th this month to claim it.

Errr... that's not the second good news, though, which I want to blog about...

The second good news is that... Randy purchased a round trip ticket SFO-MNL-SFO via Philippine Air Lines departing San Diego on Friday, Dec 21 at 09:05 PM and will arrive Manila on Sunday, Dec 23 at 05:40 AM. I set my count-down timer on: 65 days to go before Randy's next visit...

Anyway, am happy we're done with Case I and if Pacette will pickup on the 25th the NSO corrected live birth certificate, that means we're done also with Case II. One more hearing on Case III to take good care of on November 12th, and we will be waiting for its decision and finality before verification (Quezon City and Taguig), which will take us also several months.

Aw... am getting older, though, why the Philippine government does not consider Divorce Bill Law, so the men in my country don't get away from their duties and responsibilities... and, stop their double-standard marriages. It took Randy and Rose to finalize their divorce in just 6 months (USA). Why spoil the fun and happiness of older folks like me and Randy going through all these difficulties of setting me free from the marriages I had only in papers???

butterfly Case I and II: Docs Submitted to NSO

Wednesday, October 03, 2007

Pacette came back from nso and failed to submit the docs when this stupid lady refused to honor the documents furnished to me by Civil Registry - Legal from Manila and Quezon City. She said we must submit original documents duly certified by both court and civil records in Quezon City.

At the NSO

Furious, Randy and I hurriedly went to Civil Registry Records at Quezon City Hall. Mr. Matabang was in a meeting but his secretary told us to talk to Mrs. Reyes. Upon checking our documents, we were referred to Mr. Salvador Cariño, Jr. They were surprised that my documents were separated by the above stupid lady and he rearranged them in order again. He advised us to look for the supervisor to accept our docs and don't talk with that noob as she does not understand the difference between certified true copy (stamped from the court) and certified true copy of xerox copy (stamped from Civil Registry).

At NSO - East Avenue Legal Instrument Screening Section, Pacette pointed to me the stupid clerk and I took the above picture. Then I talked to the male clerk and questioned the stupid actions of the above noob. I asked for the supervisor when the male clerk seemed didn't know how to recognize original documents from xerox.

We talked to a senior female clerk who was wearing a uniform. I realized the first two on her right side were hired apprentice to screen documents. NSO offices are always full of people seeking copies of their birth records or marriage contracts. Some of these people came from far provinces and I feel sorry for them if this noob clerk asked them to submit original copy of document. What if they have exact transportation allowance? What if they have to travel back to the province without their document? I was so furious that I almost throw the document on her face. I had been so careful not to leave a mark or deface my documents, and here comes this noob lady removing the staples off my documents and stapled them anew leaving lots of dotted holes.

The security guard was standing behind us and I stared at him and warned him he's not needed there. Randy was a bit annoyed because the guard never leave us and kept listening to all my rantings. I was upset at how government employees are not well informed of their duties and they didn't even know where is NSO - Main.

Anyway, after several minutes of explanation that the documents from Manila was the most valid copy with annotation on marriage contract, the clerk accepted my documents with a note: "return excess copy" so, I will have my own copy when I claim the corrected birth certificate and nullified marriage contract on October 18.

After we're done at NSO, we had Wanton Soup and Fried Noodles with Beef and Veggies at Mongkok Dimsum, Cyberzone. Then, we went to Hypermart for some grocery shopping. Randy liikes the place because it was spacious than the grocery we used to do our shopping.

At home, Randy cooked Spanish Rice while I cooked Broccoli and Beef Tenderloin Tips. We had our dinner a bit late waiting for daughter to eat with us. We had dinner, anyway, without Pearl but she made it when we're almost done eating.

We had ice cream while she's fixing the connection of WOW Magic Sing Videoke Microphone. I was scared to do the connection myself because I was lazy to read the manual. She hooked up the microphone to Sansui's amplifier. My stereo component is 3 years younger than my daughter. Pearl is independent since 6 months ago. She will be 24 in December and currently working in a Call Center.

My daughter's visit made me forget the annoying experience I had earlier this morning. Randy and I are looking forward to Case III's last hearing which will be held on November 12, 2007 at 10:30 am.

butterfly Case I: Certification is released

Thursday, September 27, 2007

Pacette and I arrived at Civil Registry - Legal Section, Manila City Hall at 10:00 o'clock in the morning and claimed the certification from Sally that my marriage to Abdulelah is null and void. We are supposed to go to NSO to do the annotation but we do not have enough time to do so.

We had a quick breakfast at Jollibee then went to Eddie's Furniture, paid the 5 pc Dragon Wooden Sala set, gave them my address where to deliver the items and presto! Thirty minutes after we arrived home, furniture was delivered, assembled, and we moved some stuff around the house.

At past 7:00 o'clock in the evening, Tintin and I did some quick grocery shopping. I got lost again at the SM - North EDSA grocery because every time I went there, they were moving things around while remodelling the store. Since two months ago, things had been like this and I couldn't complete the stuff I needed. I have learned from the cashier, remodelling will be done in November. I was annoyed on our way home because I didn't find the cheese I want for the burger.

At past 9:00 o'clock in the evening, everything is ready for Randy's arrival... he will be happy to know that we're almost done with Case I...

butterfly Case III: Subpoena

Tuesday, September 18, 2007

Pacette and I went to RTC this afternoon.

I handed Php 2,000 for the Sheriff's transportation expense who will serve the subpoena to the one who issued the Certification of Non-Issuance of Marriage License, Municipal Civil Registrar of Cardona, Rizal. Atty. R paid Php 100 for the subpoena fees.

The next hearing will be on November 12, 2007 at 10:30 am.

butterfly Case I: Under Processing

Tuesday, September 11, 2007

Tintin and I went to Civil Registry Records in Manila City Hall to follow up the documents I submitted on August 8th. Ms. Dolor gave me a phone number where I can call to check status of Annulment papers but unfortunately, the number was just ringing and no one dares to answer since Friday.

At Civil Registry-Legal Dept., I found out from Ms Beng that they have problem with their phone instrument and the telephone company does not send their lineman yet to replace it. Anyway, glad that I went there to check personally because Ms Dolor was absent and won't be able to answer my call...

My papers are still under processing and hopefully, it will be released on the 27th.

butterfly Case I: Documents Submitted

Wednesday, August 08, 2007

Waking up at 6 o'clock in the morning in a stormy weather was kind of hard. We have tropical storm named "DODONG" (WUTIP) that brought continuous rain since last night.

After my shower, I logged online and chatted with Randy. We played Unification Wars game but later on, he pushed me to go to Manila City Hall to claim marriage contract's CTC.

Tintin and I arrived at 9:50 am at Civil Registrar's Legal Section, Manila City Hall. Ms. Dolor claimed the CTC for me and she's been going to different departments checking on my records. Upon receipt of SECPA copy of marriage contract from me along with Finality and Decision, she told me to pay at the Cashier. I paid Php 610.00 for Nullity and Php 210 for transmittal. I handed the two receipts to Ms. Dolor which she attached to my documents. She gave me a small piece of paper with telephone number in it. She told me to make a call to follow up the status of my Nullity request after one month, so that will be on September 7 or 8...

butterfly Case I: CTC of Marriage Contract

Tuesday, August 07, 2007

Tintin and I arrived at Civil Registry Office in Manila City Hall at 9:00 o'clock in the morning. I went directly to Legal Section but the clerk who checked my documents asked me to submit the latest Certified True Copy of marriage contract.

In another counter, I filled up a request for CTC, then submit it to the guy who wrote down data, then asked me to pay Php 30.00 to the cashier. Upon payment, the guy in another counter cut off a portion of my request and gave it to me. He told me to claim it tomorrow morning at 9:00.

Upset, I went to Public Assistance counter and asked whether they can expedite the release of my CTC request but, since most of the employees assigned in the Marriage Records Section are new ones, retrieving of documents is a bit slow.

On our way back home, Tintin and I decided to do some shopping at SM - North Edsa. It was about 9:45 am, and the mall was closed to the public until 10 am. We sit down and had breakfast in McDonalds instead.

After the breakfast, I bought a heavy duty stapler in National Book Store while Tintin was duplicating two keys. Then, we did a quick grocery shopping. Budget's tight and we had 9 bags only of grocery stuffs this time. Right after we came out of the mall, we're lucky to get a taxi cab.

When we arrived in the building where we live and unloading the grocery bags from the trunk, the taxi driver closed it. I was shocked and told him there's one more grocery bag inside. He pushed the trunk down twice instead of opening it for me. I was serious when I ordered him to open it as there's one more grocery bag inside, and I saw the last grocery bag there full of veggies. Upset, I handed him Php 100.00 but, instead of giving me the Php 45 change, he started the engine and fled away. In that very moment, I couldn't do anything but capture the taxi driven by the run-away driver. He fled with my Php 45 change. Since the moment I was loading the groceries into the trunk and he never offered some help, I sensed already the taxi driver's negative aura. He doesn't help also unload the groceries, which rarely happen. Randy and I always give tips to those who deserve it but this one might have a big problem that he wanted my grocery bag so badly and planned to take it away...

Dishonest Driver
Dishonest taxi driver, plate number TKG 697

As soon as I logged online, I hurriedly told Randy about everything. But, he didn't liked the idea that I will not pick up the CTC tomorrow in exchange of playing DeathMatch. He said our papers are more important than Unification Wars game.

Errr... speaking of Unification Wars game, my online friend, John, dropped me some meaningful lines... he wants me and Randy doing more of a real life thingy instead of playing online games. I told him both Randy and I are just killing time while waiting for our documents to be done. John said he reads my blog and follow my life in words and he believes that Randy is like a knight in shining white armor... glad to know that my online friends are wishing me and Randy best in life and happiness...

butterfly Case III: Direct Examination

Wednesday, August 01, 2007

Tintin and I arrived on time at RTC for Case III. The case was heard in a Family Court by an acting-presiding judge. It's the best court room I'd been to (for the three cases), it's an air-conditioned room and equipped with microphone and video camera.

I, being the petitioner, was presented for direct examination. I was cross-examined by the Hon. Public Prosecutor. The Question and Answer scene lasted for about 10 minutes only.

My counsel then requested for the issuance of Subpoena Duces Tecum and Ad Testificandum against the person who issued the Certification of Non-Issuance of Marriage License, Municipal Civil Registrar of Cardona, Rizal.

Next and (will be the last) hearing is on November 12, 2007 at 10:30 am.

After the hearing, I paid Atty R her appearance fee and she told me to prepare next week the amount of Php 500 for the transcript and Php 3,000 for the Subpoena and Sheriff fees.

Tintin and I hurriedly went back home and I told Randy what happened. We played Unification Wars and helped me reset my DP.

Then, Tintin and I left at 3 pm to Civil Registrar's Office when Randy went to bed. We picked up Case I and Case II documents and they advised me to bring Case I Finality / Decision to Civil Registrar's Office in Manila and let them update their records there before going to annotate my civil records in NSO - Manila Legal Department and NSO - East Avenue Legal Department.

We didn't stayed that long at the Releasing Section and we decided to buy Kowloon's Jumbo Siopao and Asado Siopao on our way to visit Papa at Quezon City General Hospital.

At the hospital, Papa was smiling when I brought his favorite siopao. He said we just arrived on time because he was so hungry and didn't liked the fish they were serving there lately. Papa has uncontrolled type 2 diabetes and been feeling hungry and thirsty all the time. If lucky, he might be discharged from the hospital tomorrow morning.

August First is indeed a good day for me. I have done the most difficult part of Case III; I have also in possession the signed copies of Finality and Decision for Case I and II; and, most of all, Papa can go home and live a normal life, just like he used to... but, of course, his cellulitis is still healing... only time knows whether Papa will be good enough to follow doctor's instructions on how to take good care of himself well.

With my fingers crossed... God bless us all!

butterfly Case I and II: Verified

Wednesday, July 18, 2007

Tintin and I went to Civil Registrar's Office at 9:00 am and paid Php 750.00 for Case I (Annulment) and Php 500.00 for Case II (Correction of DOB), after submitted CTC of Finality and Decisions were verified.

Next appointment will be on August 01, 2007 at 3:30 pm but I must be there before 11:00 a.m., because I have a scheduled hearing for Case III.

On our way home, I was in deep thought. I never realized annotation of my documents will take longer than expected. At home, Randy was surprised that we're back in less than 2 hours.

In the Unification Wars game, everyone resets early and Randy logged out to bed at 1:30 pm my time. He rarely went to bed that early but since he had barely slept last night due to severe toothache caused by his bad fall last week with his chin first. Both of us are actually suffering from gum sensitivity. I had mine aggravated when I ate 10 pcs of Ponkan like crazy last Friday.

Anyway, I feel better today and we recited the rosary before he left to work. We missed doing the usual prayers last night when I burned my tongue from the mouthwash. Yeah.... sometimes, I made small things bigger... it's my careless nature...

butterfly Case III: Reset in August

Tuesday, April 24, 2007

Following the scheduled April 20 hearing on Case III: Annulment at 11 am last Friday due to the early retirement of the presiding judge to hear my case, I was informed by my lawyer, Atty. R, through SMS that it is reset to August 1, 2007 at 11 am.

I find this very unfair to all Filipino people that the justice system in this country is kind of slow and had been affected us emotionally and financially.

There will be a national election next month... new promises... same faces... same justice system...

butterfly Case III: Fourth Reset

Friday, April 20, 2007

This is the fourth time Case III: Annulment has been reset.

The last hearing was on February 26 this year when the presiding judge was sick. Second time was when the presiding judge attended an official conference in the USA. The first one was because of Gloria Arroyo's SONA.

The first three consecutive reset, I paid my lawyer her appearance fee even though my case has not been given a chance to be heard. All we did was signed a paper acknowledging that the case had been reset to this so-and-so schedule.

I didn't leave today to meet my lawyer. She told me last night over our phone conversation that she received a bad news that the presiding judge had an early retirement effective last Monday, long before she hears my testimony. Atty R told me not to leave the house until she's certain there is a Pairing Judge assigned to hear my case. Why pairing Judge? Pairing Judge is a temporary judge until Presiding Judge is assigned.

I woke up early, got ready, and I received a phone call from her that there's no available Pairing Judge to hear all scheduled hearing for today. Knowing how desperate I was as this is the fourth time, she told me to stay home and she will sign in my behalf the next hearing schedule.

In short, no appearance fee to pay, and many thanks to Atty R for being considerate about this case.

butterfly Case II: Ex-Parte

Wednesday, October 25, 2006

Pursuant to the Order dated October 18, 2006, allowing me, the petitioner, to present evidence ex-parte, I, through my counsel, testified before the Branch Clerk of Court this afternoon.

We identified documents in support of my Petition. After the completion of my testimony, my counsel asked 15 days within which to submit the written Offer of Evidence.

So far, I'm happy that this will be the last hearing for this year. I paid Php 5,000 for it and also gave my counsel her appearance fee.

Pearl and I did some grocery shopping on our way home and we're saddened that after careful budgeting, I paid too much for the same items we've been buying regularly.

butterfly Case III: Pre-Trial Rescheduled

Wednesday, September 27, 2006

At RTC, I paid Php 500.00 this morning for the transcript of the stenographic notes taken down by the Court Stenographer during the hearing for Case I, held in the morning of July 27th, when they put me in the witness stand.

I had a scheduled Pre-Trial Hearing for Case III - Annulment of Marriage this morning at 10:30 am but, unfortunately, the presiding Judge is in the USA for an official conference since September 23rd.

This is the second time that this particular hearing had been rescheduled. The first one was because of Gloria Arroyo's SONA. What made me furious was, I paid for my lawyer's appearance fee and all she did was signed the rescheduled hearing for October 23rd.

There will be two hearing for next month: one is set on the 18th for Case II and on the 23rd for Case III.

The delay to hear the case made me so upset...

butterfly Case II: 3rd Hearing

Wednesday, August 23, 2006

Pacette arrived at 7 am this morning and we left to RTC to attend a hearing for Case II, for the Correction of my Birth Record.

Our case is number 9th in the court calendar. The Office of the Solicitor General (OSG) filed its Notice of Appearance on July 27, 2006 and delegated authority to the Prosecutor's Office to represent the State in the instant case. My counsel undertook to furnish the Prosecutor a copy of the Petition within 5 days from today.

Next hearing is on October 18th at 8:30 am. As usual, I gave Atty. R her appearance fee before Pacette and I went to Smart Wireless Center and Abenson.

At Cyberzone, I went to Smart Wireless Center first and took a number then I proceeded to Abenson to claim the washing machine hose. We found out that all new washing machine does not provide any hose anymore but, they gave me a free laundry basket instead, as part of their washing machine promo.

We then went back to Smart Wireless Center and I complained about the annoying experience we had in Hong Kong when incoming calls and text messages failed to get through my mobile. Text messages had been sent a day later and identical messages were sent repeatedly in different times. When I verified how much international roaming calls and text have I spent for the entire Hong Kong trip, the Php 5000 I paid in advance had all been consumed!

When Ate Neth picked up her Chinese slimming tea last night, she told me that even Smart's local SMS were received and sent late since we were in Hong Kong, cited her experience with her text message to mama as an example.

Anyway, am upset that the correction of my birth record is causing us so much time and money. I was wondering how many more months will I have to wait to get favorable result...

Meanwhile, Randy made it to San Diego minus his luggage at past 3 in the afternoon my time. PAL flight to SFO had been delayed and unable to release his luggage. United Airlines will deliver his luggage tomorrow.

Unfortunately, we're not able to recite the rosary before he left to work because his rosary and prayer book were inside his luggage. Also, he's still suffering from severe pain on his left lower rib, which he got when he lifted one of our luggages out of the bus service in Hong kong airport.

Get well soon, Randy!

butterfly Case III: Signed my Affidavit

Tuesday, July 18, 2006

I was still half awake when I received a text message from my lawyer. She wants me to sign the affidavit for Case III at 2 p.m. this afternoon.

Randy was chatting with me when I received it. As I was selling to him the regular blogs we usually traded in BlogShares, I sent my lawyer a reply that I can make it at 3 p.m. instead. I mentioned I was a bit weak due to what happened last night.

I left with Pearl at 2:30 pm, when Randy logged out and went to bed. I signed the affidavit, paid the lawyer her fee, and we did some shopping at Cherry Foodarama, on our way home.

Everything seemed normal until Randy went back online tonight. We recited the rosary together and I promised I will go to bed as soon as I bought back all the shares he sold before he logged out for work.

Ate Neth just called and advised me to have my blood sugar checked tomorrow. If Pacette, my younger sister, will drop by, I might give it a try. They're worried something bad might happen with me if I ignored what has happened last night.

Anyway, I will have PRE-TRIAL HEARING on Monday for Case III and TRIAL HEARING on Thursday for Case I. Wish the interrogation isn't that stressful...

butterfly Typhoon Florita

Thursday, July 13, 2006

Randy and I barely played in the shares market because we're busy in the new BlogShares Chances game. When Blogshares do a DB maintenance, we both watched America's Got Talent and Law and Order using Yahoo webcam. He logged out at 2:30 pm Manila time.

In spite of stormy weather that suspended all classes today, my eldest sister, AT, left this afternoon to Hong Kong.

Couple of times we had power fluctuations and interrrupted cable tv signals due to bad weather so I gave up using my PC. Typhoon Florita claimed 11 lives and caused millions of property damages. Evening news reported that Baguio and La Union are under State of Calamity while Metro Manila is under water.

Typhoon Florita

My son and I took advantage of the bad weather to sing our hearts out but, I was interrupted by a phone call from Abdulelah's best friend, Fahad, around 4:00 o'clock in the afternoon. Nasser tried to give me the contact number of Aboundanji late in the afternoon yesterday, who according to my brother, was then waiting for my call. Aboundaji was the one who introduced his lawyer, Atty. L, to the EX. However, I refused to take down the number. I told my brother I have no business to discuss anything with the friends of the EX. The EX was worried but, I told Fahad there's nothing to worry about the case at all. It's just a mere annulment and not falsification. Besides, I just want to correct my documents with National Statistics Office (NSO). Afterall, it's been 10 years now since I parted with the EX. He has his own love life now and I deserve to move on as well. I warned that neither me nor my lawyer is asking for money and if his lawyer said so, don't give any amount. Twice Fahad called because the line wasn't clear.

Back to typhoon Florita, classes resume tomorrow in Metro Manila, Regions 3 and 4. Regions 1, 2, and CAR remained suspended.

butterfly Well-planned?

Monday, July 10, 2006

Pearl and I went to see her dentist so her stitches be removed. We arrived there on time but, daughter and the dentist took some time debating whether her stitches be removed or not. After educating her about the possible consequences, she decided to let him remove the stiches.

After the dentist, we went to L & S Body Salon just opposite the building, when my brother, Nasser, called up. Straight to the point, he said the EX wants to know whether my counsel had asked for money, based on report by the respondent's counsel.

Surprised, I told him I will return the call after I talk with my lawyer. Even my lawyer was shocked when I asked her whether it's true or not. Then as the conversation went further, she realized it must had been well-planned. She was setup to meet each other at 10 a.m. at Starbucks but the respondent's lawyer arrived at past 11 a.m. Could it be possible that the meeting was planned by the other lawyer so he can meet my lawyer and told the EX later that we are asking for money?

Convinced with my lawyer's explanation, I called again Nasser. I told him to tell the EX not to give money to his lawyer because my counsel never ask a single cent. Whatever is the motive of the other lawyer, I find him dishonest about his transactions with the EX. And I had thought, what a combination, a lying EX and a lying lawyer!

I was just furious though because the Saturday conference cost me half of my lawyer's appearance fee. Some lawyers are charging per hour and others, per appearance.

Well-planned or not, only time will tell... every action has its karmic result!

butterfly Counsel To Counsel?

Saturday, July 08, 2006

My counsel has been invited by Abdulelah's counsel and they met at Starbucks, Araneta Center this morning. Atty. L told my counsel that he will cross-examine me only when it is necessary, and that will be on the 27th of this month.

The reason why they contested the Petition was because the EX has fears that I might file a Falsification case against him.

butterfly Artefacts Holiday

Friday, July 07, 2006

I called up my counsel when I received a text message from her. She informed me that she received an invitation from my EX's counsel to clarify something.

Also, she asked me whether I want to hear what the other counsel wants to say but, we had thought it could probably be a trap and maybe someone would take video from afar and will use it against us.

With my permission, I agreed that she can meet the respondent's lawyer tomorrow to hear what the EX wants to say. I forgot to ask whether she will charge me for that coffee meeting.

Meanwhile, in BlogShares game, my founded {NSI} corporation declares ARTEFACTS HOLIDAY due to recent attacks received from different hostile players, until further notice.

{NSI} members can RETALIATE and may use all their artefacts without restrictions prior to BlogShares Rules Sub-Section C - Artefact Usage.

Just because we're playing neatly, others find an opportunity to harass our held shares in top blogs and test our patience. I play to relax my mind, not to find enemies. Some players out there were having fun hurting other players' investment and harassing them away from playing the game. I couldn't imagine a gaming community wherein only top richest players are somewhat monopolizing to play the top blogs.

Strategies? No, I called it greed. Artefacts holiday is appropriate for agrieved members of {NSI}.

butterfly Case II: Hearing Resets

Wednesday, June 14, 2006

At the RTC Branch XXX, Case II, correction of birth record, is the third in the court calendar.

I arrived a bit late and my counsel manifested compliance with the Order of the Court dated May 17, 2006 by furnishing a copy of the Petition and its annexes to the Office of the Solicitor General (OSG) by personal service on June 8, 2006 as shown by the stamp receipt on the Order itself.

The Court gave the OSG a period of thirty (30) days to file Comment / Opposition thereto. Hearing is reset to August 23, 2006 at 8:30 in the morning and I paid my counsel her appearance fee + Php 500 for the service she previously paid in my behalf.

I asked my counsel why not reset the hearing next month, she told me July is judiciary inventory month. Anyway, I have two scheduled hearing on July 24th and 27th.

butterfly Case III: Collusion Report

Thursday, June 01, 2006

I was happy when I received today the copy of Collusion Report from the Fiscal's office and also the notice of PRE-TRIAL HEARING on July 24th at 10:30 am. My lawyer also reminded me about the next hearing schedule thru a text message.

So far, I will have one hearing to attend on June 14th and two hearing on July 24th and 27th. I'd thought the case will take 4-6 months only... the waiting time is kind of depressing.

butterfly Case III: Collusion Investigation

Monday, May 22, 2006

I had a bad morning, as usual, because this is the fourth day that I didn't have DSL internet. I had to use PLDT VIBE dial up internet access to chat with Randy on yahoo and retrieve my mails because even I can logged in to my ISP server, the packets sent and received were below 5,000 in five hours period.

Anyway, I logged out at 1:50 pm and went to RTC Bldg., with Pearl. I met my counsel and she briefed me before meeting the Fiscal assigned to investigate me for Collusion. We debated on some matters because she said I had to lie on one question if ever I was asked about it. Telling the truth is not all the time important in the court. They want you to tell things that is within their allowed rules or my counsel will be questioned for not teaching me the right way of talking to them.

We went to second floor (RTC BLDG) and paid PHP 500 for Fiscal fee. We then went to the fourth floor where we met the Fiscal. Four people were ahead of us and we're the last one accomodated. Unlike in the court rooms, Fiscal's office has air-conditioning and I feel better even I was nervous. So far, the investigation wasn't that difficult but just asked me questions related to contents of the petition we submitted.

After we paid PHP 300 for mailing fee, my counsel advised me not to disclose any information online on what happened with the hearing because annulment case should be kept private while the case is on-going.

I paid my counsel her appearance fee and she reminded me that our next meeting will be on June 14th, for Case II, the correction of my birth records.

butterfly Case II: First Hearing

Wednesday, May 17, 2006

Randy and I recited the rosary first before Pearl and I left to the Regional Trial Court at 8:00 o'clock in the morning...

At the court room, the place was already full and the presiding judge had over 20 cases to hear. Our case is the 10th in the Court Calendar. Both my counsel and I appeared. My counsel requested the Court for the markings of the documentary exhibits to prove compliance with the jurisdictional requirements of the petition. Accordingly, the documents were marked as exhibits.

The Judge directed the Civil Registry and Office of the Solicitor General to file their Comment within ten (10) days from today. Continuation of the hearing is on June 14, 2006 at 8:30am.

After the hearing, I paid my counsel her appearance fee and she told me our next meeting will be on May 22 at 2:00 pm before my scheduled Case III's Collusion Investigation with the Fiscal at 2:40 pm.

As soon as I arrived home, I reported with Randy what has happened and we played BlogShares again.

butterfly Case III: Subpoena

Tuesday, May 16, 2006

I found an exciting way to buy shares of top blogs when I turned ON alerts of top 150 blogs to watch. Each time someone sells or buys, I received an alert of the transaction and I can buy the shares by pressuring the public or restructure the shares (which I will pay three times of its value).

Both Randy and I had fun exchanging blog's shares ownerships after the 6 hour period is over. The game is so addicting we barely noticed the time.

As soon as he logged out and I became busy in the kitchen, I received a subpoena for Case III's Collusion Investigation on May 22 at 2:40 pm. I have a hearing to attend tomorrow and I hope I will finish these cases the earliest time possible.

butterfly Give them my number

Monday, May 15, 2006

I informed my counsel early this morning about what the EX did when he invited my brother to a meeting with him along with his lawyer. As they want me to blah blah blah about our marriage contract in court, Atty. R advised me to give her contact number instead.

When Nasser called me again in the afternoon, I gave him the contact details of my lawyer and told him not to talk with my EX about me again but, talk to my lawyer instead.

butterfly Mother's Day

Sunday, May 14, 2006

Although I received couple of greetings from my sibling and started the morning by reciting the rosary with Randy, I still had a bad morning.

I found out from Nasser that the EX let him read the document the EX's lawyer will submit on the 27th of July. My temper rises when I found out the respondent's lawyer will also push for annulment on our meeting, the Trial Conference. I'm afraid the case I filed in court will be dismissed in case EX made stupid things like favoring for the nullity of the falsified marriage. If they are not contesting, why they kept responding to court invitations? I yelled at my brother to stop talking about me and the case. I just wish my brother will not sell me on this one...

Anyway, after Randy and I logged out at 3 pm, we got ready for the church. The kids, Mama, Tintin, and I sitted on the fifth row seat. We do not have afternoon mass in the nearby chapel so we went to Our Lady of Hope Parish, near SM North Edsa. Fr. Emmanuel Bollari said the mass. The homily was about God, being the vine, and the faithful as the branches. There were times we have to trim off the bad branches and prune the good ones so it will bear better fruit. I was delighted seeing my children attending mass with me.

After the mass, we had dinner at Pizza Hut. We had fun even though Mama's sandal had broken strap, similar to what happened with mine last week. She got a new pair of sandals before we left the mall.

Anyway, siblings, close friends, and high school mates exchanged Mother's Day greetings with me while Mama got an eCard from Randy. Vera, my best friend, greeted me being the strongest mother in this world!

butterfly Nasser Called

Friday, May 12, 2006

I had an afternoon nap right after Randy logged out to bed but, I was awakened by my brother's call.

According to him, both Abdulelah (Nasser's employer) and his counsel talked to him about me several times. They attempted to get informations from him regarding the Nullity of Marriage I filed against my EX. I had thought Nasser was calling to inform me he's going to pay me his loaned money but I was only annoyed when I found out the EX wanted me to blah blah blah in court about the falsification of our marriage contract. Furious, I warned Nasser to advise his employer not to contact me again nor ask any informations from my side as far as the case is concerned because the court will not allow respondent and petitioner for collusion, as the case might be dismissed. EX was stupid enough to hire a lawyer wherein he doesn't need one if he is not interested to contest the case I filed against him. He better use his money to pay his agent's salaries and related expenses in advance.

It was not my intention to involve the EX in this case but, since the court needs the other party to be properly informed, I had to execute my affidavit narrating the facts about the past. If I could only do this all by myself, I prefer not to exchange allegations with the EX because he's just putting himself cheap in my eyes. Besides, his lies might be used against him and he might involve Leila Baque, too, who was the one who knows everything about the said marriage contract. Two years ago, Leila was jailed in Hong Kong for falsification of passport and immigration stamps of her alleged travels. Pretending to be innocent will not do him any good.

I told Nasser that it's enough that I had been cheated and it's so unfair that I'm paying for something I had nothing to do with it.

You owe me, Abdulelah!

butterfly Case I: Pre-Trial

Wednesday, May 10, 2006

Before Pearl and I left to the Regional Trial Court (RTC) in the morning, Randy and I prayed and recited the rosary first.

We had difficulty getting a cab but, thankfully, we arrived on time. The taxi driver was smart enough to take a shorter route. As we entered the court room, we waited for couple of minutes until the Presiding Judge appeared and we all stood up to start the court proceedings.

My case is the 10th in the Court Calendar. Both petitioner and counsel appeared. Only respondent's counsel showed up but clothed with a Special Power of Attorney authorizing him to represent respondent in the Pre-trial Conference. Respondent's counsel manifested that the marriage contract is a falsified document which my counsel objected to: The truth of the matter are those alleged in the Petition. The Presiding Judge ordered that the Pre-trial is terminated and scheduled the next hearing on July 27, 2006 at 8:30am for the initial presentation of petitioner's evidence. This means that I will take the witness stand on said date subject to cross-examination of respondent's counsel and the Assistant City Prosecutor, counsel for the State.

When we're done in the court room, I found out from my counsel that the judge has an official leave in June that's why the next hearing will be in July. Anyway, for that brief conference, I paid my counsel her appearance fee.

Randy was surprised that I came back home after two hours, he's very pleased that the case is moving but was annoyed by the stupidity of Abdulelah's counsel.

butterfly Case I: Affidavit

Monday, May 08, 2006

Randy and I were busy in the morning voting dead blogs to remove them off our portfolios when I received an urgent message from our counsel. My Affidavit should be signed at 3 pm today.

While waiting, I reindexed some blogs. Both Randy and I had fun buying ideas produced by industries after blogs were reindexed. The only thing we watched on TV (via Yahoo webcam and Skype) was Deal or No Deal. I was lazy to leave but, no one will do the signing in my behalf, as I have to do it myself.

Pearl accompanied me when I signed my Affidavit this afternoon. I was told it will be submitted prior to the scheduled Case I PRE-TRIAL Conference on Wednesday. Then, we did some grocery shopping first before going home. The boys were not around and we're forced to carry the goods upstairs. I still have a little knee sore and avoid lifting heavy things as much as possible to avoid further pains.

Anyway, I had an afternoon nap as soon as we arrived home. I had sleepless nights lately maybe because I was feeling bad about the previous lousy men in my life and also I worry a lot what stupidity EX will do on the scheduled PRE-TRIAL on May 10.

butterfly Case II: May 22 Hearing

Thursday, May 04, 2006

As usual, I had oatmeal for breakfast and Randy had Lasagna after we recited the rosary.

We did some Neopets and Blogshares update until we run Yahoo webcam. We watched House's Euphoria, part 2, Dr. Foreman faces death and they put him in a coma to ease the pain. Dr. House discovered contaminated water outside patient's home (who earlier died of unknown disease) as the source of the infection. It wasn't clear what happened with Foreman as he's still paralyzed when the episode ended. Well, we watched Criminal Minds and Law and Order, too, before watching NBC's late night evening news.

When Randy logged out, I received a text message from Atty. R. Case II Hearing Schedule is on May 22nd at 2:40 pm for Collusion Investigation.

In the evening as I was watching the GMA 7's 24 Oras evening news, I heard that three separate fires damaged properties in Metro Manila today. That reminds me about my discussion with Randy before he went to bed, we were discussing about Mina (a.k.a. Shelly), a well-loved index manager in BlogShares. In her blog, a friend noted that, "In the early morning hours of Sunday, April 30th, a massive fire broke out in the family home. Her sons were not in the home, as they were visiting their father. Shelly was home alone, asleep at the time."

We posted earlier a candle in Sage's Mission: Mina where I made a mistake posting my BS profile under that mission. Gladly, Island Dave was online and he removed immediately my profile off the mission page. It was embarassing though but, I had too many windows and tabs open that time and I got distracted which form I pasted my profile. Anyway, I hope Shelley will overcome the difficulties and trials she's having lately... may God bless us all!

So far, am happy that the three cases I filed last February will have it's respective hearings scheduled this month.

butterfly Best Achiever

Friday, April 28, 2006

We had three reasons to celebrate at Dad's Restaurant - West Avenue this evening.

Dinner at Dad's

First, I introduced Randy to my friend, Atty. D, and to my counsel, Atty. R, who is the one handling the three cases I filed this year. Atty. R gave me the filing receipts of Cases II and III! She advised me to be ready for the series of hearings to be held in May and June.

Next, is to celebrate my Pearl's graduation day from the Automotive Course but, she surprised me with her Best Achiever TESDA Award and Certificate! Congratulations, Sweetie!

Third, it's Tintin's 26th birthday! Happy Birthday, Tintin!

butterfly Case III: Ads

Tuesday, April 25, 2006

I stayed in bed most of the day because of knee injury.

Pacette paid 11.5k in my behalf for the publication fee in Today's Ads for three consecutive weeks, for the public notice of the correction of my birthdate.

Randy takes very good care of me. He wanted me to relax and watched the last episodes of House, then we watched also The Fugitive, Dirty Harry, and Forest Gump movies in DVD.

We went to bed early because I was still ill.

butterfly Case II: No Reply Yet

Friday, April 07, 2006

Atty. R updated me this evening that she didn't receive any reply yet from the respondent. He has until the 5th of this month to submit his reply to the case filed against him.

My counsel will then file a motion to refer case for collussion investigation on Tuesday if she doesn't receive any reply yet until Monday afternoon.

butterfly Case II: Summon Served

Tuesday, March 28, 2006

Atty. R sent me a message thru SMS that summon for Case II was personally served on March 21st, based on transmittal she received from Montalban RTC.

The respondent has until the 5th of April to submit his reply.

butterfly Case I: Hearing Schedule

Tuesday, March 21, 2006

Atty. R informed me through SMS that PRE-TRIAL Hearing for Case I, Declaration of Nullity of Marriage pursuant to Art. 35 (4) in relation to Art. 42 of the Family Code, is set at 8:30 am, RTC Branch XX on Wedneday, May 10th! Order for Collusion Investigation had been cancelled because the respondent submitted a reply.

Meanwhile, we are awaiting transmittal of the summon from Montalban RTC for Case II. I wish God will make these legal proceedings easier for us...

butterfly Case II: Summon

Thursday, March 16, 2006

Pacette obtained new copy of my birth record from NSO this morning with yellow security paper (secpa) but, unfortunately, the copy she received didn't have the notation of corrected entry I made in 2003. As advised by my counsel, I instructed her to go back to NSO Legal Office and advised Pacette that they will release the annotated copy on the 23rd of this month. They denied receiving the Finality copy mailed to their office three years ago. This upsets me that human errors could ruin my documents someday.

Pacette submitted the copy of my original birth certificate with green secpa this afternoon as requested by my counsel for Case III. She also picked up the two petitions for Case II and III , along with the REPLY from Abdulelah's counsel. As expected, the EX fabricated lies but, he failed to make me angry. In fact, I feel sorry for him. Maybe EX can lie to all but, not in his heart and conscience! Actually, he doesn't need to submit a reply and leave things as they happened but, court will not tolerate collusion between respondent and petitioner so I remained quiet about it. My counsel advised me not to communicate with the respondent.

Service of Summon for Case II had been received in Montalban and their sheriff will serve it either today or tomorrow

butterfly Judgment of Dissolution

Wednesday, March 15, 2006

Randy sent me this morning the scanned copy of Judgment of Dissolution he obtained from the San Diego Superior Court, dated 13th March 2006, effective date of termination of marital or domestic partnership status.

Meanwhile, my counsel received the REPLY copy mailed to her by EX's counsel from Iligan City last Friday I'm still awaiting for Case I PRE-TRIAL Investigation. Someone told me that EX was in Saudi Arabia to attend his eldest son's wedding. I wonder who will receive the invitation if he's not in the country? Sigh. I also wonder why I have to suffer going through with the Nullity of the Marriage I never had.

For Case II, hopefully, summon will be served anytime this week and for Case III, am awaiting order for publication which might start next week.

butterfly Case II and III: Raffled Off

Thursday, February 23, 2006

Atty. R informed me thru SMS that Case II, Declaration of Nullity of Marriage Pursuant to Art. 3 (2) in relation to Art. 4 of the Family Code, has been assigned to RTC Branch *** presided by Hon. RLP and Case III, Petition for Correction of Entry in the Certificate of Live Birth, RTC Branch ***, presided by Hon. TV.

All I have to do is wait until Case II Summon will be signed and served. I still have to pick up copies of my Petition for the above cases.

butterfly Anticipated Phone Call

Monday, February 20, 2006

Finally, at 4:05 o'clock this afternoon, I received a call from Abdulelah's best friend, Fahad, while soul mate and I were chatting. We anticipated this phone call since Saturday. This confirmed the summon for Case I has been received.

Anyway, I was hesitant to answer all questions Fahad asked me. I was worried the call was a trap and anything I say might be used against me. However, I advised him I cannot talk with the respondent because the case has been filed already and he should consult his own lawyer for guidance as communication and/or collusion between respondent and petitioner can lead to dismissal of the case.

He said he's going to call again once he gets home and that made me more worried.

I have so many questions that bother me:

1. Is the respondent obliged to submit reply within 15 days?
2. Does the respondent needs to appear before fiscal/judge?
3. Do I have to give them the telephone number of my counsel?

All the above questions had been answered by my counsel. Thanks, God, I feel better now.

butterfly Case I: Summon Is Served

Friday, February 17, 2006

According to my counsel, the summon for case I has remained unserved last Wednesday because the sheriff reported that no one was there in the address indicated to receive it.

However, she said there's nothing to worry about since it has been served today! She advised me to expect a call from Abdulelah anytime soon. Respondent will be given 15 days to submit his answer.

butterfly Case III: Requirements Submitted

Wednesday, February 15, 2006

After completing all requirements instructed by my counsel to provide, Pacette submitted in my behalf 6 copies for each documents today and paid Php 1,700.00 for filing fee.

Both Case II and III will be filed on Monday since my counsel will draft the Petition for Case III today. My next meeting with my counsel will be on Collusion Investigation which will probably take place between March and April.

butterfly Case I: The Summon

Tuesday, February 14, 2006

Case II was supposed to be filed yesterday but, I instructed my counsel to hold it until today. I reviewed the Petition myself and was satisfied with it. She told me that the summon for Case I has been signed today and will be served tomorrow by the Sheriff.

She gave me the hint that EX will probably call me the moment he receives the summon.

butterfly NBI Clearance

Thursday, February 09, 2006

After I transfered some funds from Equitable PCI Bank to Allied Bank, Pacette and I then went to NBI - Megamall to renew my NBI Clearance but, unfortunately, my personal copy had been submitted with the Swiss embassy in 2003. Based on instructions I have read, only those with duplicate copy can apply there thus, those who do not have duplicate copy of NBI should go to Main NBI office at Carriedo Plaza.

In NBI - Carriedo, I filled out a new application form and went through longer procedures. Upon completing Step 6, they told me to go back on the 14th to claim my NBI Clearance. If only the duplicate copy was with me, I didn't have to wait until Tuesday for the release of my NBI clearance, I could get it the same day.

Anyway, Tintin reminded me that our Voter's ID were all available for pick-up so, Pacette and I went to Parañaque City and claimed all our IDs. Now that I have completed all requirements, I am ready to submit them to start Case III on Tuesday.

Meanwhile, Case I has been assigned to RTC Branch **.

butterfly Talk To Me

Wednesday, February 08, 2006

My EX Saudi Arabian hubby had been calling at home but, I didn't answer the phone. After series of failed attempts, he sent a letter through my brother Nasser, who is working for him as his liaison officer in Saudi Arabian embassy.

"Why you don't want to talk to me?" He asked in his letter but, in my mind, what else do I want to discuss with him? I want the Bigamous Marriage be annulled soon and it upsets me to hear more lies from him. Because of his action, I have to pay over a hundred thousand pesos to correct the mess he and Leila Baque created. I had been used and abused but, I will leave everything in the hands of God.

He said he still wants to see me and didn't want me to pursue with the case but, I am determined to do this once and for all.

butterfly Driver's License

Tuesday, February 07, 2006

In securing more identification as part of Case III requirements, I renewed my deliquent driver's license today. I took series of medical, drug testing, written, and practical tests. Then, I received my new license past 2:00 o'clock in the afternoon.

After LTO-Diliman, Quezon City, I was supposed to get NBI Clearance but, I saw the long lines of applicants. I changed plan and picked up instead the copy of Case I Petition from my counsel then, I submitted draft copy of Petition for Case II. I paid Php 5500 for it's filing and summon fees. Through diligent communication by my sister, Pacette, with the biological father of the kids, we finally get his contact address yesterday where summon for case II will be served. He is connected with Philippine National Police (PNP) and currently one of the bodyguards of a known senator.

We're tired but, I did some grocery shopping on my way home.

butterfly Case I: Petition Filed

Monday, February 06, 2006

A 5-page Petition for Declaration of Nullity of Marriage pursuant to Art. 35 (4) in relation to Article 41 of the Family code, has been filed today at 3:00 p.m. by my counsel.

butterfly Case I: The Petition

Saturday, February 04, 2006

Pacette and Tintin accompanied me when I submitted today the edited copy of the Petition for Case I. I gave Php 5750 for its filing fee on Monday.

butterfly Three Men, Three Cases

Friday, February 03, 2006

Three Men, Three Cases have been added as new archive category today and from now on, all updates on my Annulment and Correction of Birth Records will be filed under this category for my readers' convenience and quick reference.

WHY THREE MEN, THREE CASES?

  • CASE I: Bigamous Marriage with Saudi Arabian stepfather of my kids who registered our "alleged marriage" on 19 December 1991 without my permission. I have learned about the marriage when Switzerland Embassy here in Manila showed me the National Statistics Office (NSO) copy of my Marriage Contract with him when they denied my visa application to work in Geneva, Switzerland in 2003.
  • CASE II: Annulment of invalid marriage contracted with the biological father of the kids on 11 July 1979 in spite of the fact it was duly registered with NSO. I just found out it was invalid the other day.
  • CASE III: Correction of date of birth. Chinese relatives of my father had this bad habit of tampering our birth records to prevent mother from seeking financial support, in case mother will file for child support. Those were the days that they never realized that computerization of birth records will be available these days.

These three men played important roles in my life and had caused me so much suffering even to this day.

Fortunately, the fourth man, my potential soulmate offered to correct all these mess in my life starting from the day I was born. May the Almighty God make these things easier for both of us.
